On the transactional front, we prepare complete commercial-purpose, real estate-secured loan documentation — loan agreements, promissory notes, deeds of trust, security agreements, guaranties, and environmental indemnities — as well as modification and extension agreements and memoranda of modification. When loans go sideways, we advise on enforcement strategy: forbearance agreements, non-judicial foreclosure under CC § 2924, guarantor liability and breach of guaranty actions, anti-deficiency analysis under CCP § 580d, credit bid strategy, lender liability defense, and usury defense. We manage the entire lifecycle from origination through resolution.
Winning a judgment is not the finish line — collecting is. Our judgment enforcement practice operates primarily in the six-to-eight figure range ($500,000 to $15,000,000+) and encompasses the full arsenal of California post-judgment remedies. We record and enforce abstracts of judgment, issue and execute on writs of execution, levy on bank accounts, securities accounts, and safe deposit boxes, and pursue wage garnishments against judgment debtors and their spouses. We strategize and execute Sheriff's execution sales — including advising on bidding strategy, credit bidding, and overbid dynamics. Where judgment debtors have concealed or transferred assets, we pursue fraudulent conveyance and alter ego claims. We conduct debtor examinations and third-party examinations to compel disclosure. We turn paper judgments into collected funds.
